Millbrook man asks for new trial, gets hit with heavier prison sentence | News
MILLBROOK, AL (WSFA)- An Elmore County man recently headed back to court for a second time on the same charges he pleaded guilty to in 2011. But instead of being handed the freedom he expected, the jury sent back a guilty charge and the man was hit with a prison sentence nearly five times more than his original plea.
Court documents show that Gary H. Jones, now 41-years-old, pleaded guilty to seven counts of first-degree sodomy and three counts of first degree rape back in November 2011. He was sentenced to spend 20 years in prison.
His attorneys say the crimes were committed between 1987 and 1990 - Jones technically would have been a juvenile, however he was dealt with as an adult. In January 2012, Jones' attorneys filed a motion to withdraw their client's plea and subsequent sentence saying he should have been prosecuted as a youthful offender.
Authorities had to start all over again - this time they filed a motion to have Jones certified as an adult.
Jones was arrested and charged with the exact same charges earlier this year after an Elmore County grand jury indicted him on all 10 counts.
Today a jury convicted him of one count of rape in the first degree - the jury was hung on the other nine charges.
But instead of his original 20-year prison sentence, Jones will now have to serve 99 years in prison since he was tried as an adult and convicted.
Court records showed that the victim in the case was a family member younger than the age of 15. The abuse took place over an 11-year period.
